The judgment in favor of the plaintiff in the ■courts below adjudges that the defendant, under a deed of conveyance to him by Eeuben E. Fenton on the 23d day of December, 1870, of certain lands in the county of Chautauqua, then became and was, and ever since has been, seized and possessed thereof, and of the proceeds, rents, issues and profits, in trust for Waldo Hutchins, the plaintiff’s testator, to the extent of an equal undivided one-half part thereof as tenants in common.
