Appeal from the general term of the Supreme Court, in the fifth district, where judgment had been entered in favor of the defendant, upon a special verdict. (Reported below, 10 Barb. 97.) This was an ejectment to recover the north half of lot No. 130, in George Scriber’s fish-pond, or location, in Constantia, in the county of Oswego. The defendant was in possession at the commencement of the action.
