H. U. Justice, Jr., herein called plaintiff, instituted an action against Safeguard Insurance Company, sometimes called defendant, seeking a judgment for $4,000 with interests and costs. Plaintiff alleged in his motion for judgment that on December 4, 1959, he secured a judgment for that amount against Leamond E.
