HENSHAW, J., Dissenting.
I dissent. In the opinion of the learned chief justice three main propositions are discussed. The first, the sufficiency of the indictment; the second, the legality of the instructions; the third, the adequacy of the evidence. As to each of these propositions it is demonstrably true that this court’s decision is at variance with that of every other court which makes the English common law the basis of its jurisprudence.
