This is an appeal from an order of the district court granting summary judgment in favor of appellee Mobil Oil Corporation and against appellant William C. Hays. Hays v. Mobil Oil Corp., 736 F.Supp. 387 (D.Mass.1990).

Hays is the executor of the estate of Arthur Groves. From 1940 to 1977, Groves was the proprietor of a Mobil gas station located on property Groves owned in Waltham, Massachusetts. Groves retired in 1977 and leased the station, still operating as a Mobil franchise, to his former employee, David King. In 1982, Groves died. Hays, as Groves’…
