MEMORANDUM AND ORDER
WOLF, District Judge.
Plaintiff William Hays, the executor of the estate of Arthur Groves, has brought suit against defendant Mobil Oil for indemnification of cleanup costs on property owned by the estate. The property was formerly the site of a Mobil franchise owned and operated by Groves. Defendant has moved for summary judgment on all counts, relying primarily on the statute of limitations and the existence of a contractual indemnification clause in its favor.
