In a proceeding pursuant to CFLR article 78 to review a determination of the Zoning Board of Appeals of the Town of Huntington dated September 27, 2007, denying the petitioner’s application for a use variance, the petitioner appeals from a judgment of the Supreme Court, Suffolk County (Jones, Jr., J), entered April 14, 2009, which, upon a decision of the same court dated May 13, 2008, denied the petition and, in effect, dismissed the proceeding.

Ordered that the judgment is affirmed, with costs.
