MEMORANDUM OPINION
DiCLERICO, District Judge.
The plaintiff, Omnipoint Communications Enterprises, Inc. (“Omnipoint”), brought this action against the defendant, the Town of Amherst, New Hampshire (“Town” or “Amherst”). The plaintiff alleges that the defendant violated the Telecommunications Act of 1996 (“TCA”), Pub.L. No. 104-104, 110 Stat. 56 (1996), in connection with the plaintiffs attempt to locate personal communication service (“PCS”) facilities in Amherst.
