Appeal from an order of the Court of Claims (Hard, J.), entered February 23, 2009, which, among other things, granted defendants’ motion to dismiss the claim and/or for summary judgment dismissing the claim.
On December 7, 2006, decedent tragically fell to his death from one of the movable dams at Lock 9 of the Erie Canal on the Mohawk River.
