The majority holds that Portland City Code (PCC) 14A. 60.010 is constitutional under Article I, section 27, of the Oregon Constitution. I disagree with the majority’s holding because (1) the majority’s interpretation is at odds with the interpretation advanced by the city; (2) the majority’s interpretation is at odds with the rule of construction that legislative enactments are to be construed to express the intention of their drafters; (3) the majority’s interpretation fails to inform an ordinary person what the circumstances are that will result in the person being…
