Plaintiffs, A-l Cigarette Vending, Inc., et al. (“plaintiffs”), representing several tobacco vending machine owner/operators,1 filed a Complaint against the United States (“defendant”), alleging that the Food and Drug Administration (“FDA” or the “agency”) effected a temporary regulatory taking upon plaintiffs by promulgating certain tobacco regulations that were to ban the sale of cigarettes and smokeless tobacco from most vending machines.
