SAWTELLE, Circuit Judge.
This is an appeal from a decree canceling a policy of public liability insurance issued by the appellee upon an automobile owned by the appellants Fred and Tom Strangio.
The application for the policy of insurance was made by Tom Strangio to Emile L. Matthias, in Stockton, Cal., where they resided, on the morning of Saturday, October 18, 1930. At that time Strangio asked Matthias to procure public liability insurance on three certain automobiles, including the Sludebaker automobile here involved.
