This suit was instituted by appellant, B. Lambert, in the district court of Wichita county on the 6th day of August, 1925, complaining of G. N. Gant and wife, Emma Gant, and W. P.*' Stokes and wife, Annette Stokes, alleging that on or about the 20th day of October, 1924, the plaintiff and defendants entered into “a written agreement” whereby the defendants agreed to execute and deliver to the plaintiff in escrow with the Wichita State Bank <& Trust Company, of Wichita Falls, an oil and gas lease on what is commonly known as “producers’ 88 form,” on a tract of land described in the petition,…
