This ease is now before the Court on the Government’s Motion for Reconsideration of the Court’s Order Denying Defendant’s Motion to Dismiss. In support of its motion, the Government cites the recent Supreme Court decision John R. Sand & Gravel Co. v. United States, — U.S.-, 128 S.Ct. 750, 169 L.Ed.2d 591 (2008). The Government argues that this new decision precludes the Court from considering whether certain equitable considerations warrant extending the statute of limitations contained in 28 U.S.C. § 2501.
