C. F. Avery commenced this action in the district court of Okfuskee county against J. H. Goodrich et al., the defendants dbove named, doing business under the firm name and style of the Weleetka Gin Company, in which he sought jucigmeut in the sum of $9,692.92. A demurrer to the petition was sustained by the district court and the cause appealed to this court and reversed, the same being Avery v. Goodrich, 103 Okla. 156, 229 Pac. 577, in which case will be found a statement of the allegations of the petition. In that appeal it was held that the petition stated a good cause of…
