LIVINGSTON, Chief Justice.

This is an appeal from the Circuit Court of Jefferson County, Alabama, in Equity.

The Board of Managers of the Firemen’s and Policemen’s Supplemental Pension System, appellees, brought a declaratory judgment action against the City of Birmingham, appellant, to test the constitutionality of Act No. 556, Acts of Alabama 1959.
