This is an action in mandamus in which plaintiff, the District Attorney of Bucks County, seeks an order to compel defendant, the Controller of Bucks County, to authorize the payment to plaintiff of the annual salary of $44,000 under and pursuant to ordinance no. 39 enacted by the Commissioners of Bucks County on July 20, 1976. A complaint has been filed to which defendant has filed an answer and new matter and a reply to that new matter has been filed by plaintiff.
