Appellee, WillB Hadley, occupied the) position of treasurer of the City and County of Philadelphia from January, 1934 to January, 1938. During his term of office the Act of April 8, 1937, P. L. 256, was passed. 1 At the expiration of appellee’s term, the controller of the City and County of Philadelphia, Eobert C. White, in compliance with the provisions of Article XII, sections 5 and 6 of the First Class City Charter Act of June 25, 1919, P.
