Johnston, C. J.:

The defendant was convicted of. having burned a barn and its contents with the intent to defraud an insurance company. The information contained two counts, one charging the defendant with burning a bam, and the other with burning the building and the property in it for the purpose of defrauding the insurer. The burning with which the defendant is charged occurred in August, 1916. Prior to his arrest and about March 15, 1917, a statutory investigation was held by the state fire marshal and the county attorney in the latter’s office,…
