In June 1996, plaintiff, Michael C.A. McPherson (“McPherson”), filed a four count complaint against his former employer, Maryland Public Employees Council 67, (“Council 67”) and ten individuals for violations of the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001 et seq. (“ERISA”), breach of contract, promissory estoppel and failure to comply with Maryland’s Wage Payment and Collection Law, Md. LaboR AND Employment Code Ann. § 5-501 et seq.
