OPINION

Dawud Majid Mu’Min appeals an order of the district court dismissing his petition for a writ of habeas corpus, 1 which challenged his Virginia conviction for capital murder and resulting death sentence. See 28 U.S.C.A. § 2254 (West 1994). 2 We conclude that the district court correctly held that the refusal of the Supreme Court of Virginia, under the rule set forth in Slayton v.
