This action is brought to recover for damages to certain goods kept in a store, situated on the southerly side of Oak Street, in block 77, of the city of Globe, occasioned by the flooding of the store, during a heavy rainstorm on the fourteenth day of July, 1919. It is claimed that the flooding was caused by an insufficient drain constructed by the city. The city demurred to the complaint on the ground that the *282same does not state facts sufficient to constitute a cause of action. This demurrer was overruled.
