Plaintiff, Charles C. Shafer, landlord of certain improved real estate in Somerset, Pa., served notice, under the Act of March 31, 1905, P. L. 87, upon Matt Cascio, to vacate and deliver up possession of the premises within 30 days, “to wit, on or before the first day of November, 1924.” The property not being surrendered, plaintiff commenced a proceeding under the Act of December 14, 1863, P.
