Two matters are for consideration: first, is this a case of which the court should take original jurisdiction? If it is, a second question must be answered: shall the injunction be granted?
The Philadelphia Gas Works Company asked the court to take original jurisdiction 1 in an emergency produced by threats publicly made by the Mayor of Philadelphia followed by his Proclamation, in effect, declaring forfeiture of property rightfully in petitioner’s possession and his intention to seize it and exclude petitioner therefrom, with force, if necessary.
