This is an appeal from a judgment for defendants in an action brought to enforce the lien of a street assessment on a parcel of *351land in the city and county of San Francisco. The Court rendered its decision, comprised in the following findings of fact and conclusions of law:
“ This cause came on regularly to be heard before the Court sitting without a jury, on the 11th day of September, 1877, when the parties appeared by their respective counsel, ready for trial.
