A jury convicted appellant of capital murder pursuant to Section 19.03(a)(5)(B), Texas Penal Code, which makes it a capital offense for a person to knowingly or intentionally murder another person, while in*693carcerated in a penal institution, -with the intent to establish, maintain, or participate in a combination or in the profits of a combination.
