J. E. Hickey was convicted before a justice of the peace of the offense of selling whiskey without a license, and upon appeal to the circuit court, was convicted upon a state of facts as follows: In January, 19.14, a petition was filed with the county court asking that license for the sale of intoxicating liquors in the city of Fort Smith, Sebastian 'County, be issued to them. J. D. Arbuckle and others were made parties to the proceeding.
