This matter is before the court on cross-motions for summary judgment. Defendant and third-party plaintiff Everest Development, Ltd. (“Everest”) seeks partial summary judgment on Count I of the counterclaim and third-party complaint which alleges copyright infringement. Plaintiffs CSM Investors, Inc. and James M.
