This is an appeal by the State of Illinois, Department of Revenue (“Department”) from a summary judgment entered by the Bankruptcy Court in favor of appellees, Joel Schechter (“Schechter”) and the Continental Insurance Company (“Continental”) and from a denial of the Department’s cross motion for summary judgment.
