MEMORANDUM OPINION
JACK B. SCHMETTERER, Bankruptcy Judge.
The contested issue discussed here relates to the Debtor’s bankruptcy case now pending under Chapter 7 of the Bankruptcy Code.
This dispute arises from a 1990 agreement entered into by the former Chapter 7 trustee Jay Weisman (“Weisman”) to litigate jointly “lender-liability” claims held by Debtor Weisser Eyecare, Inc. (“Weis-ser” or “Debtor”) and Debtor’s former principal shareholder and president Phillip Hirsch (“Hirsch”) against NBD-Highland Park.
