Plaintiff Rine brought the action for damages for personal injuries sustained by him in a collision between an automobile driven by him and one driven by the defendant Isham. The defendant answered, alleging that the accident was solely the result of the negligence of the plaintiff or that the plaintiff was guilty of contributory negligence, and counterclaimed for damages arising from the accident.
