Appeal from a judgment of tbe superior court for Stevens county, Carey, J., entered July 10, 1905, in favor of tbe defendants, upon granting a nonsuit at the close of plaintiff’s case, in an action to recover damages for malpractice.

This action was brought to recover damages for malpractice. On the 14th day of January, 1904, the plaintiff sustained a fracture of both bones of the left leg, at or near the ankle joint, while taking out limestone for the 27orthport Smelter. The accident occurred about eleven o’clock in the forenoon, and the plaintiff was immediately removed to the 27orthport hospital, conducted by the defendants, for treatment. About four o’clock in the. afternoon of the same day, the defendants set the bones, and placed the leg in a plaster cast extending from the knee down over the foot. The leg remained…
