This is an application for a writ of mandate to compel the respondents to pay to the petitioner certain tax moneys collected and in the course of collection for county highway purposes. Upon the return of the alternative writ the matter was submitted on a demurrer to the petition for want of sufficient facts. The proceeding" involves the scope and effect of section 2656 of the Political Code added as a new section in 1907 (Stats. 1907, p. 63).
