The surrogate decided that the testatrix was partially insane during the spring and summer of 1856, but that the will was executed in a lucid interval. The Supreme Court did not assent to the conclusion of the surrogate that the testatrix was partially insane prior to the making of the will, but they concurred with him in' the opinion that she was of sound and disposing mind when the will was executed.
