The respondent was convicted of assault and battery in circuit court on appeal from a similar conviction in justice’s court.
The evidence indicates that the parties (complainant *506and defendant) had an altercation over the pay for some bolts and timber, sold by complainant to defendant. It culminated in the alleged assault while they were going to the depot, after an agreement had been reached. The details of the affair need not be stated.
