OPINION OF THE COURT

RAICHLE, Senior Judge:

This case is a government appeal pursuant to Article 62, UCMJ, 10 U.S.C. § 862 (1988). At trial, the military judge excluded evidence that was substantial proof of a fact material in the proceeding. He made this ruling on 20 July 1993, and the trial counsel gave the military judge written notice of appeal of the ruling the following day. Our first encounter with the ease occurred on 24 August 1993 when the Chief Government Appellate Counsel filed an authenticated copy of the record of the proceedings with the court.
