ROSE, District Judge.
The plaintiff says the defendant infringes in the aggregate five claims out of a much larger number contained in two patents owned by him. These patents are for candy pulling machines. In the last few years the candy pulling industry has been revolutionized. • Prior to the beginning of this century candy was always pulled by baud. In factories that operation is now performed by machinery. One small aqd simple machine will do the work of ten men and will do it better than they can.
