This is an appeal from the judgment of the Supreme Court of the District, wherein upon a verdict of the jury damages were awarded Waller, plaintiff below.

The appellant here, defendant below, is an electric common carrier between Washington, D. C., Baltimore, Md., and Annapolis, Md. Its railroad traverses a section of Maryland. The plaintiff, a colored man, testified in substance that he purchased a round-trip ticket (of defendant) from Washington to Annapolis, upon which he rode in a car on one of appellant’s trains, sitting about midway of the car, in which…
