This cause is before the court following the grant of rehearing. Oral arguments on rehearing have been held and the matter now stands submitted.

This wrongful death action was instituted by Nita Yazzie as administratrix of the estate of her deceased husband, Daniel Joseph Yazzie. Defendants in the case are John Herman Sullivent, H. J. Jeffries Truck Lines, Inc., and Excel Insurance Company.
