This is an appeal from a judgment of dismissal following the sustaining, without leave to amend, of a demurrer to a complaint for malicious prosecution of civil proceedings.

The action by appellant Charles O. Cowles was for damages for alleged malicious prosecution of a prior civil action. The prior proceeding was filed in 1974 in the Superior Court of Los Angeles County, entitled “Carin Ann Carter and Howard Carter v. Charles O.
