View Point Medical Systems, LLC (“View Point”), plaintiff, brought suit against athenahealth, Inc. (“Athena”), defendant, alleging six claims: fraud in the inducement (Count I); breach of contract (Count II); two claims of intentional breach of the implied covenant of good faith and fair dealing (Counts III and IV); tortious interference with prospective advantage (Count V); and “Tort Arising From Breach of Contract — Actual Malice” (Count VI).
