This appeal is from a denial of the plaintiffs petition for a new trial on the ground of newly discovered evidence. The underlying action for personal injuries arose from a rear end collision between the plaintiffs automobile and a truck driven by the defendant’s employee. Summary judgment was granted for the plaintiff on the issue of liability, and a trial to a jury was held on the issue of damages.
