Civil action in tort to recover damages for personal injuries.

On Sunday, 27 April, 1941, plaintiff and defendant, brothers, were returning to Whitakers, N.C. from Bellamy's Mill in an automobile owned and operated by defendant. Defendant was driving about 35 miles per hour on a dirt road. As they approached an intersection or fork in the road defendant passed another vehicle going about 20 miles per hour.
