This case, coming to the writer recently, is an action for damages for personal injuries. Plaintiff's petition alleged that while plaintiff was standing on the sidewalk near the intersection of two public streets, "the defendant carelessly and negligently drove and operated an automobile in such a manner as to run ontothe sidewalk, striking plaintiff and causing plaintiff to be pinned between said automobile and a building." Defendant's answer was a general denial. Plaintiff recovered a verdict for $14,000, and from the judgment entered thereon defendant has appealed.
