Now pending before the court is a motion to dismiss for failure to state a claim or, in the alternative, for summary judgment, filed by defendant Mayor and City Council of Baltimore (the “City”) against plaintiff Daniel Wemhoff. Mr. Wemhoff is suing the City for violating the Excessive Fines Clauses of the federal Constitution and the Maryland Declaration of Rights 1 , the federal Constitution’s Fourteenth Amendment’s Due Process Clause, and Article 31, Section 3-5 of the Baltimore City Code.
