MEMORANDUM OPINION AND ORDER

SIM LAKE, District Judge.

Petitioner, Steven Anthony Butler, currently in the custody of the Texas Department of Criminal Justice (“TDCJ”), filed this federal habeas corpus application pursuant to 28 U.S.C. § 2254. Butler was convicted of capital murder and sentenced to death for the murder of Velma Clemons during the course of a robbery.
