On May 23d, 1938, the Council of Boise City passed, and the Mayor approved an ordinance granting to the Boise Water Corporation a franchise to own, maintain and operate a water system in Boise, specifying that it was to take effect on the thirty-first day after its passage and approval.

On June 22d, 1938, there was filed with appellant, M. A. Regan, as City Clerk, 42 separate referendum petitions signed by 2,052 persons, requesting that such ordinance be submitted to vote of the people before going into effect. The next meeting of the Boise City Council following the filing of…
