E. K. Hardison Company upon being sued by a customer for an alleged breach of warranty in the sale of lima bean seeds, called on Continental Casualty Company, its insurer under a comprehensive general liability insurance policy, to defend. Continental declined, contending it had not insured against loss or damage on account of breach of warranty. Whereupon suit was brought in which relief was sought upon three theories: first, for a reformation of the policy so as to provide coverage for any liability of the Seed Company for its alleged breach of warranty; second, for a declaratory judgment…
