Defendant Hayim Regensberg (“Regensberg”) moves the Court pursuant to Rule 12(b)(3)(B) of the Federal Rules of Criminal Procedure for an order directing the Government to either to elect or to dismiss certain counts of Superseding Indictment SI 08 Cr. 219 (VM) (the “Indictment”).
