THIEME, Judge.

Appellant, Morris Helman, trading as Barclay National Mortgage Group, appeals from an order of the Circuit Court for Baltimore City releasing appellee, Ruth Kim, from a duly recorded mortgage lien. Appellant presents the following questions for our review, which we have rephrased for clarity:

1. Did the lower court err in determining that the presumption of payment regarding unreleased mortgages in § 7 — 106(c)(1) of the Maryland Code, Real Property Article, is not rebuttable?
